Acceptance of Terms

By engaging with Wayfarer Films' services, productions, or content, you ("Client", "Partner", "User") agree to these Terms and Conditions. If you do not agree, you must refrain from using our services.

Services

Wayfarer Films is engaged in:

  • Film and video production
  • Distribution and marketing of films
  • Creative services (scriptwriting, editing, design, promotions)
  • Event management and media-related activities

Separate project agreements may outline additional terms.

Intellectual Property

All creative works produced by Wayfarer Films, including films, scripts, music, artwork, and promotional materials, remain our intellectual property unless transferred under a written agreement.

Clients must ensure that any material they provide (logos, footage, music, scripts, etc.) is original and does not infringe third-party rights.

Client Responsibilities

  • Provide accurate information and timely approvals.
  • Ensure necessary legal rights, clearances, and permissions for content they supply.
  • Be responsible for compliance with laws applicable to their project.

Confidentiality

Any business, script, or project details shared with Wayfarer Films will be treated as confidential and not disclosed without consent, except as required by law.

Fees and Payments

  • All invoices must be paid as per agreed timelines.
  • Delayed payments may attract late fees and suspension of work.
  • Refunds, if any, will be processed in accordance with specific project agreements.

Cancellations & Delays

Wayfarer Films may reschedule or cancel projects due to unavoidable circumstances (technical failures, natural calamities, legal restrictions, etc.)

Clients cancelling confirmed projects are liable to cover costs incurred up to the cancellation date.

Limitation of Liability

Wayfarer Films shall not be liable for indirect, incidental, or consequential losses arising from its services.

Our maximum liability will not exceed the total amount paid by the client for the concerned project.

Use of Likeness

By participating in Wayfarer Films productions, cast and crew grant consent to use their name, image, and performance in promotional and distribution activities unless otherwise agreed in writing.

Third-Party Services

Wayfarer Films may engage third-party vendors (equipment rentals, studios, technicians). We are not liable for any issues arising from third-party services, though we ensure due diligence in selection.

Termination

Wayfarer Films may terminate a project or engagement if:

  • The client violates these Terms.
  • The project involves illegal, unethical, or harmful activity.

Governing Law & Jurisdiction

These Terms shall be governed by the laws of India, specifically under the jurisdiction of the Courts of Ernakulam, Kerala.

Amendments

Wayfarer Films reserves the right to amend these Terms from time to time. Continued engagement after such amendments implies acceptance.
